The Court approved settlement in the matter of Morefield v. NoteWorld, LLC, Nos. 1:10-CV-00117, 1:11-CV-00029, 2012 WL 1355573 (S.D. Ga. April 18, 2012).  These class action lawsuits alleged that NoteWorld accepted charges, fees, contributions, and combinations of the same from representative plaintiffs and the settlement class, which, when considered in addition to the fees charged to Georgia residents participating in debt settlement or adjusting plans administered by third-party debt settlement companies, exceeded those permitted by the Georgia Debt Adjustment Act.  Id. at *1. read more

In Palmer v. Convergys Corp., No. 7:10-cv-145, 2012 WL 425256, at *2 (M.D. Ga. Feb. 9, 2012), Plaintiffs sought to proceed as a class action, and argued that the class action waiver found in their employment contract was invalid.  The Middle District of Georgia disagreed and denied Plaintiff's Motion to Proceed as a Collective Action.  Id. at *1. read more

Despite the U.S. Supreme Court's finding in Concepcion, 131 S. Ct. 1740 (2011), that class action waivers in arbitration agreements are often unconscionable, it appears the waiver may live on. read more

This past summer, the Northern District of Georgia granted an injunction against enforcement of Sections 7 and 8 of House Bill 87, the notorious Georgia Illegal Immigration Reform Enforcement Act, as requested by members of a class action. read more
